Terms of service

1. Who we are, and what you agree to
These terms govern your use of the Cruise Itinerary website at cruise-itinerary.com and its data API at cruise-itinerary.com/v1 (together, the "Service"). The Service is operated by Agile Travel Group, Inc., doing business as Cruiseable ("we", "us"). By creating an account, requesting a key, or calling the API, you agree to these terms. If you accept them for a company, you confirm you can bind that company.
If you do not agree, do not use the Service. You must be at least 18, or the age of majority where you live.
2. The Service
The Service provides cruise reference data (lines, ships, ports, itineraries), weekly fare snapshots, port-day traffic, a change feed and the Cruise Price Index. It is read-only. Endpoints, the plan that unlocks each, and the limits of each plan are described on the documentation and pricing pages, which form part of these terms.
3. Accounts and keys
You sign in with a link sent to your email address. You are responsible for that mailbox and for every call made with your keys. Keep keys secret and out of client-side code. Revoke any key you think has leaked, from your dashboard. You may hold up to ten active keys. Give us accurate contact details and tell us if they change.
One person or company, one account. Do not create accounts to avoid limits or to share a plan between unrelated parties.
4. Plans, payment and cancellation
The Free plan costs nothing. Paid plans are charged in US dollars, in advance, monthly or annually as you choose, through Stripe. Current prices: Developer $149 a month, Business $749 a month, each ten times that for a year. Platform and Enterprise are agreed in writing.
Paid plans renew automatically until you cancel. You can cancel at any time from your account. Cancellation takes effect at the end of the period you have paid for, and your account then returns to the Free plan. We do not refund part-used periods, except where the law says we must. Prices can change; a change applies from your next renewal and we will tell you by email at least 30 days before it.
Prices exclude taxes. Where we are required to collect sales tax or VAT, it is added at checkout. If a payment fails, we may downgrade the account to Free until it is settled.
5. Limits and acceptable use
Each plan has a per-minute rate limit and, on some plans, a monthly call cap. You agree not to:
- exceed or evade those limits, including by rotating keys, accounts or IP addresses;
- probe the Service for weaknesses, or interfere with it or with other customers' use of it;
- use the Service to break the law or anyone else's rights;
- pass off our data as your own, or remove attribution where these terms require it.
If you reach a limit the API returns 429 and you can try again, or move to a higher plan. We do not charge overage.
6. Your licence to the data
Subject to these terms and to your plan, we grant you a non-exclusive, non-transferable, revocable licence to call the API and to use the data it returns in your own products, services, research and internal analysis, including showing individual records to your end users. You may keep copies as long as your use is consistent with this licence.
You may not, without a written agreement with us (Platform or Enterprise): resell, sublicense or republish the data, or any substantial part of it, as a dataset or data service; build a service whose purpose is to substitute for ours; or use bulk files for anything beyond what your plan allows. The identity files (lines, ships, ports, destinations, regions) are open to everyone, and the licence above applies to them on every plan.
We own the compilation: the identifiers, the resolution of names, the derived itinerary days, port-day figures, change events and index values. Underlying facts about ships, ports and sailings belong to no one, and we claim no rights in them. Ship, line and port names, and logos, belong to their owners. We are not affiliated with or endorsed by any cruise line.
7. What the data is, and is not
Fares are weekly snapshots taken from a supplier feed. They are not live bookable fares, they are not an offer to sell, and they may differ from what a cruise line or travel seller charges you. A missing fare means the cabin was not offered or was sold out when we looked. Itinerary days other than embark and disembark are estimated by us, and flagged as such. Port-day figures are derived from those itineraries and published ship capacities, and they are counts of scheduled ships, not of people.
Confirm anything that matters to a purchase, a journey or a safety decision with the cruise line before you rely on it.
8. The Cruise Price Index
The index pages and the open index endpoint are free to read. You may quote and chart the index values with a link to cruise-itinerary.com/price-index. Do not present them as a guarantee of any price, or as financial advice.
9. Webhooks
Where your plan includes webhooks, you give us a public HTTPS address and we send change events to it. You are responsible for that endpoint, for verifying signatures, and for what it does with the data. We may disable an endpoint that repeatedly fails, as the documentation describes, or that we reasonably believe is abusive.
10. Availability and changes
We aim for a dependable service but do not promise any level of uptime or any particular data refresh time. The weekly load can be late or skip a week. We may change, add or remove features. For a breaking change to an endpoint on /v1 we will give paying customers at least 60 days' notice by email.
11. Suspension and ending
You can stop using the Service and close your account at any time. We may suspend or end an account that breaks these terms, that puts the Service or others at risk, or whose payment has failed, and where practical we will warn you first. We may also end the Service as a whole; if we do, we will refund the unused part of any prepaid period. Sections that by their nature should survive (data rights, disclaimers, liability, governing law) do.
12. Warranties
The Service and its data are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement.
13. Liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, bookings or data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the event giving rise to it, or one hundred US dollars if you paid nothing. Nothing in these terms limits liability that cannot be limited by law.
14. Governing law and disputes
These terms are governed by the laws of the United States and of the state in which Agile Travel Group, Inc. is incorporated, without regard to conflict-of-law rules. Courts in that state have exclusive jurisdiction over disputes, except that either of us may seek urgent relief from any competent court. Before filing a claim, write to us and give us thirty days to resolve it.
15. Changes to these terms
We may update these terms. For material changes we will email account holders, and post the new date above, at least 30 days before they take effect. Using the Service after that date means you accept them. If you do not, close your account before then.
